INDEPENDENT CONTRACTOR RENTAL AGREEMENT

Terms Of Use:  By signing this rental agreement, Renter(s) agree to the following: 

Rates:  Private session $25.00 for each equipment used per hour, 

           Semi-Private session $20.00 for each equipment used per hour,

           Classes (3 or more) $10.00 for each equipment used

           Whole Studio $50.00 perpre hour 

A 50% retainer is required to hold studio and rental items and any special event date. The retainer will be applied to final bill and balance will be due on or before the date of your rental. The date and studio/rental items are not reserved until retainer and signed rental agreement are submitted to and received by the Studio. The retainer is non-refundable.

The studio may be used for legal business activities only. There is absolutely NO SMOKING or ALCOHOL in the building. Smoking is allowed outside the building. Renter is responsible for clean- up of smoking-related debris (ashes, cigarettes, etc) before leaving.

ARRIVE AND LEAVE ON TIME
• The lease shall start and end as set forth in this Agreement; set-up and clean-up time must take place during hours set forth in this Agreement.
• An hourly charge of $50.00 per hour will be applied for each additional hour that extends beyond rental terms, as set forth in this Agreement.

BE RESPECTFUL OF OUR NEIGHBORS
• Be present at all times during the rental
• Keep the event or session contained within the studio
• Maintain adult supervision of minors at all times
• Clean up trash or other items on premises prior to leaving 

STUDIO & EQUIPMENT SUPPLIED:
The Studio agrees to provide the studio in good working order but makes no special guarantees as to said studio’s functionality or suitability to the
Renter’s purposes. The Renter is entitled to use the entire studio, front and back yard, lighting equipment, props and any furniture in the studio at the time of rental. The Studio is not liable for acts out of its control that affect the shoot, such as power outages, weather, emergencies, or Acts of God. Renter agrees to return all equipment, studio, and furniture in the condition it was provided and to immediately notify the Studio of any damage, failure, or change in equipment provided. Rental furniture may be taken outside, one piece at a time. If there is inclement weather in the forecast (rain, snow, etc.) then the furniture may not be taken outdoors. Please do not move any equipment larger than a single chair unless without two people are present to move it without dragging the legs.

 

DAMAGE TO EQUIPMENT, FURNITURE, OR STUDIO:
Renter agrees to pay for any repair or replacement costs of equipment, furniture, or studio that Renter damages within 3 business days. In the event that the Renter’s employees, Renter’s contractors, Renter's clients, or any and all Renter's visitors damage any equipment or studio, Renter agrees to pay for any repairs or replacements necessary within 3 business days. Renter agrees to leave the studio in the condition it was found, or a $100 cleaning fee will be assessed and invoiced.

There is no guaranteewarranty that rented items are free of defects.

The Renter agrees that the Studio holds no liability for any damage or injury caused by use of rental items to Renter or any third party. The Renter assumes all risk of personal property damage or personal injury. If any accident involving the Studio's rental items has occurred while it is in the Renter's possession, Renter shall make the Studio aware by written statement of details of the occurrence of event including the police report and names and addresses of witnesses, if applicable.

LIABILITY:
Renter agrees to get a signed Liability Release from all persons that will be on the premises prior to use of Studio. The Studio will not be held liable for any injuries or accidents to the Renter, Renter’s employees, Renter’s contractors, Renter's clients, or any and all Renter's visitors that occur within or outside the studio premises.

Use of the studio requires the following in advance:

• Signed Studio Rental Agreement
• Ccopy of Renter's Instructor Insurance 
• Photocopy of Renter’s Drivers License

The premises are to be used for the purpose of a Pilates Session, Workshop, or photography/videography studio, including such activities, as are necessary and usually incidental to such use. The Studio shall have the right to inspect the equipment, studio, and furniture at any time during the rental term. Renter shall make any and all arrangements necessary to permit a representative of the Studio access to the equipment and studio. If a breach of any of the provisions of the
Rental Agreement occurs, the Studio has the right to revoke the Renter's access to the equipment and studio without any liability to and without
prejudice to the Studio, and the right to receive rent due or accrued to and including date of revocation.

Returned checks will incur additional charges including but not exceeding all bank fees plus a $25 processing fee. 

Refund requests must be made in writing and will be responded to promptly by management. If the equipment, furniture, or studio is ordered and delivered, but not used, no refund will be approved. 

SCHEDULE AND PAYMENTS:

Renter will checkchecks the studio availability and book equipment on the Shared Calendar or Check with Kae at 808-557-1000/pilatesbydolly@gmail.com. Renter needs to book the studio at least 3 days in advance. 

The payment day is every MONDAY for the previous week. DK Body International Inc will send an invoice for the previousfor previous week.

 

CANCELLATION POLICY: 

Renter must cancel 24 hours in advance to avoid the charge.

 

COVID-19 PROCEDURES:

Renter agrees to obtain a signed Covid Liability Release, and to abide by the following:

• Renter will check the temperature of each client upon their entering the facility. If the client’s temperature is over 100.4° F, the rental must be cancelled.

• All parties must wear a mask at all times while in the Studio or anywhere on the premises. No exceptions.

• Renter will sanitize all equipment and props after use.

• Renter is responsible for enforcing the social distancing of their clients. Please maintain a distance of 6 feet between each client.

• If you or your client(s) are exhibiting any symptoms of COVID-19, the rental must be cancelled. These symptoms include: fever or chills, cough, difficulty breathing, fatigue, muscle or body aches, headache, loss of taste or smell, sore throat, congestion or runny nose, and nausea or vomiting.

If a rental must be cancelled due to COVID-19 related reasons, there will be no charge for that rental.
